Purpose

This document/page sets forth the principles, guidelines and requirements of the Terms of Service of TeamSites.com and Associated Sites ("TeamSites") governing the use by the Customers and Visitors ("Customers") of TeamSites's services and products ("Services and Products"). The Purpose of this Terms of Service is to comply with all Federal, State, Provincial, and local laws coupled with protecting the server security, server availability, physical security, Customer privacy, and other factors affecting the services provided by TeamSites.

TeamSites reserves the right to impose reasonable rules and regulations regarding the use of its services provided to all Customers and Visitors and such rules and regulations are subject to change. The terms of service is not an all inclusive exhaustive list and TeamSites reserves the right to modify this document at any time as needed. Any violation of this Terms of Service may result in the suspension or termination of Customer account(s) or such other action as TeamSites deems appropriate. No credits will be issued for any interruption in service resulting from policy violations.

VIOLATION OF ANY SECTION OF THE TERMS OF USE/SERVICE IS STRICTLY PROHIBITED AND MAY RESULT IN THE IMMEDIATE TERMINATION OR SUSPENSION OF THE SERVICES CUSTOMER OR VISITOR RECEIVES FROM TeamSites.

No Warranties

THIS SITE, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN IT OR ANY SITE-RELATED SERVICE, IS PROVIDED "AS IS" WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN PARTICULAR (BUT WITHOUT LIMITATION), TEAMSITES DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIALS ON THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Limitation of Liability

TeamSites, its affiliates, and sponsors, are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to the Site, Site-related services and/or content, or information contained within the Site. Your sole remedy for dissatisfaction with the Site and/or Site-related services is to stop using the Site and/or those services.

Intellectual Property

TeamSites may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of laws, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or other intellectual property rights; including creating, utilizing, distributing unauthorized copies of software, or the use of BitTorrent or other types of technologies utilized in the distribution of illegally copied materials. If Customer copies, distributes or installs software in defiance of the license agreement, Customer is violating federal copyright law. TeamSites will cooperate with all law enforcement agencies in relation to alleged copyright infringement housed on our servers.

All text, graphics and multimedia content available from TeamSites domains (including but not limited to teamsites.com and teamsitesfiles.com) and pages within those domain (the "Site") and all related code (including but not limited to HTML, other mark-up languages, and all scripts) within this site are the property of TeamSites and/or its affiliates. All material on this Site, including (but not limited to) images, illustrations, audio clips and video clips, is protected by copyrights that are owned or controlled by TeamSites or by other parties that have licensed their material to TeamSites (or posted to the Site pursuant to a user agreement with TeamSites). Material from the Site may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way. Modification of the materials or use of the materials for any other purpose is a violation of copyright and other proprietary rights. The use of any such material on any other Web site or computer environment is prohibited.

Content Policy

Each Customer is expected to execute reasonable Internet etiquette (Netiquette), the accepted behavior and expectations of the Internet community. The Customer/Visitor will comply with the rules appropriate to any network to which TeamSiets may provide access. The Customer should not post, transmit, or permit Internet access to information the Customer desires to keep confidential. The Customer is not permitted to post any material that is illegal, libelous, and tortuous, indecently depicts children or is likely to result in retaliation against Maine Hosting Solutions by offended users. Maine Hosting Solutions reserves the right to refuse or terminate service at any time for violation of this section. This includes advertising services or sites via IRC or USENET in clear violation of the policies of the IRC channel or USENET group.

Customer shall not post, transmit, re-transmit or store material on or through any of Services or Products which, in the sole judgment of TeamSites is (i) in violation of any local, provincial, state or federal law or regulation, (ii) threatening, obscene, indecent, defamatory or that otherwise could adversely affect any individual, group or entity (collectively, "Persons") or (iii) violates the rights of any person, including rights protected by copyright, trade secret, patent or other intellectual property or similar laws or regulations including, but not limited to, the installation or distribution of "pirated" or other software products that are not appropriately licensed for use by Customer. Customer shall be responsible for determining what laws or regulations are applicable to its use of the Services and Products.

Independent Review

Independent Review CUSTOMER ACKNOWLEDGES THAT MEMBER HAS READ THIS AGREEMENT AND ALL RELATED SITE INFORMATION REFERENCED AND INCORPORATED IN THIS AGREEMENT AND THAT CUSTOMER AGREES TO ALL ITS TERMS AND CONDITIONS. CUSTOMER HAS INDEPENDENTLY EVALUATED ALL ASPECTS OF THIS AGREEMENT AND THE DESIRABILITY OF ENTERING INTO THE TRANSACTIONS CONTEMPLATED IN THIS AGREEMENT AND IS NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN THOSE EXPRESSLY SET FORTH IN THIS AGREEMENT.
